Welcome to Crochyt! These Terms of Service ("Terms") govern your access to and use of the Crochyt platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

Acceptance of Terms

By registering for an account or using the Service, you represent and warrant that:

  • You have the legal capacity to enter into a binding contract

  • You will provide accurate and complete information

We reserve the right to modify these Terms at any time. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.

Account Registration

Eligibility

You must be at least 16 years old to use the Service. By registering, you represent that you meet this age requirement.

Account Termination

User Types and Responsibilities

Buyer Responsibilities

  • Provide accurate shipping information
  • Pay for orders in a timely manner
  • Communicate professionally with designers/factories
  • Follow the return policy guidelines

Designer Responsibilities

  • Create accurate and honest listings
  • Fulfill orders according to specifications
  • Communicate professionally with buyers
  • Honor the stated production and shipping times
  • Maintain quality standards for all work

Factory Responsibilities

  • Provide accurate yarn specifications and pricing
  • Maintain sufficient inventory for listed items
  • Ship orders according to stated timelines
  • Ensure yarn quality meets advertised standards
  • Respond to buyer inquiries in a timely manner

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Illegal Activities: Use the Service for any illegal purpose
  • Intellectual Property: Infringe on copyrights, trademarks, or other intellectual property rights
  • Fraud: Engage in fraudulent, deceptive, or misleading activities
  • Harassment: Harass, abuse, or threaten other users
  • Spam: Send unsolicited messages or spam
  • Security: Attempt to circumvent security measures or access unauthorized areas
  • Impersonation: Impersonate any person or entity
  • Malware: Upload or transmit viruses or other malicious code

Violation of these prohibitions may result in account suspension or termination and legal action.

Fees and Payments

Platform Fees

Crochyt charges the following fees:

  • Buyers: May pay a 3% platform fee on custom design requests
  • Designers: Pay a 3% platform fee on accepted bids
  • Factories: No platform fees on yarn sales
  • Payment Processing: Standard payment processing fees apply

Payment Processing

All payments are processed through secure third-party payment processors. We do not store your complete payment information.

Refunds and Disputes

Refunds are processed according to our Return Policy. In case of disputes between users, Crochyt may mediate but is not liable for the outcome of transactions between users.

Intellectual Property

Crochyt Content

All content, features, and functionality on the Service, including but not limited to text, graphics, logos, and software, are owned by Crochyt and are protected by intellectual property laws.

User Content

By posting content to the Service, you grant Crochyt a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your content for the purpose of operating the Service.

Third-Party Content

The Service may contain links to third-party websites or content. We are not responsible for the content or practices of these third parties.

Disclaimers and Limitation of Liability

Service Disclaimer

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Crochyt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

User Responsibility

You acknowledge and agree that you are solely responsible for your use of the Service and any content you post or share through the Service.

Indemnification

You agree to indemnify, defend, and hold harmless Crochyt, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content posted on the Service

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Nairobi, Kenya, in accordance with the rules of the Chartered Institute of Arbitrators of Kenya.

Class Action Waiver

You agree to resolve any disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

Termination

By You

You may terminate your account at any time by contacting us or through your account settings.

By Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Survival

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
